Official External Resources
We have included links below to official resources which employees may find helpful when dealing with workplace issues, early conciliation and Employment Tribunal claims.
ACAS Early Conciliation
If you are considering bringing an Employment Tribunal claim, you will usually need to notify ACAS first through Early Conciliation. This is a free process which gives the parties an opportunity to try to resolve the matter before a claim is issued.
Start an Employment Tribunal claim
If your matter is not resolved, you may be able to start an Employment Tribunal claim online using the official government service. Time limits are strict, so employees should take care to issue claims in time.
Employment Tribunal Rules
The Employment Tribunal Procedure Rules set out the rules and procedure that apply to Tribunal claims. Employees may find it helpful to review these rules when considering or pursuing a claim.
ET1 Form
The ET1 is the form used to bring an Employment Tribunal claim. Employees can review the form in advance to understand the information which may be required.
Frequently Asked Questions
How does the ACAS "pause rule" affect my tribunal deadline?
When you start ACAS Early Conciliation, the 3-month deadline to file a claim is "paused." The time spent in conciliation (up to 12 weeks) is added back to your deadline, giving you more time to prepare your case.
What should I include in a Subject Access Request (SAR)?
A SAR should clearly state that you are requesting all personal data held about you under the Data Protection Act. It is often used to uncover internal emails or notes that support your claim.
Is statutory redundancy pay tax-free?
Yes, the first £30,000 of a redundancy payment (including the statutory element) is typically tax-free in the UK.
